These Terms & Conditions govern the use of the content and services offered through the Eat The Frog application ("Eat The Frog", "Eat The Frog App" or "the App"), Eat The Frog website and Eat The Frog social media accounts (collectively "Services").
By downloading, installing, or using Eat The Frog, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a legally binding agreement between you and Kinobo Studios Limited ("we", "us", "our"). We license use of Eat The Frog to you on the basis of these Terms & Conditions. We (or our affiliates and/or third party licensors, where applicable) remain the owners of Eat The Frog at all times.
To use Eat The Frog, you must be at least the age of majority in your jurisdiction or have parental/guardian consent. By using the App, you confirm that you meet these eligibility requirements.
To use Eat The Frog, registration is not required, but to download and use the App you must sign in with your Apple ID or Google ID. Relevant rules of Apple Inc. and Google Inc. respectively located at: https://www.apple.com/itunes and https://play.google.com/store apply.
Eat The Frog offers optional subscription plans that unlock premium content and features. Payments are processed securely through Apple's App Store or Google Play billing systems. We do not collect or store any payment card information. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.
We are committed to ensuring that the App is as useful and efficient as possible. For that reason, we reserve the right to make changes to the App or to charge for its services, at any time and for any reason. We will never charge you for the App or its services without making it very clear to you exactly what you're paying for.
It's your responsibility to keep your phone and access to Eat The Frog secure. Certain functions of the App will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider. We cannot take responsibility for the App not working at full functionality if you don't have access to Wi-Fi, and you don't have any of your data allowance left.
If you're using the App outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the App, or other third party charges. In using the App, you're accepting responsibility for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off data roaming. Along the same lines, you need to make sure that your device stays charged – if it runs out of battery and you can't turn it on to avail the service, Eat The Frog cannot accept responsibility.
We accept no liability for any loss, direct or indirect, you experience as a result of relying wholly on the functionality of the App. At some point, we may wish to update the App. The App is currently available on iOS and Android – the requirements for systems (and for any additional systems we decide to extend the availability of the App to) may change, and you'll need to download the updates if you want to keep using the App. We cannot guarantee that we will always update the App so that it is relevant to you and/or works with the iOS/Android version that you have installed on your device. We may also wish to stop providing the App, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the App, and (if needed) delete it from your device.
If you are not the bill payer for the device on which you are using the App, please be aware that we assume that you have received permission from the bill payer for using the App. You agree to use Eat The Frog only for lawful purposes and in accordance with these Terms. You must not:
All content, design elements, and intellectual property within Eat The Frog are owned or licensed by Kinobo Studios Limited. You are granted a limited, non-exclusive, non-transferable license to use the App solely for personal, non-commercial use. No other rights are granted unless expressly stated.
Eat The Frog integrates with RevenueCat to manage subscriptions. By using the App, you agree to RevenueCat's terms of service and privacy policy. Apple and Google also have their own terms governing in-app purchases.
Eat The Frog is provided "as is" and "as available," without any warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation of the App or that it will meet your specific needs.
To the maximum extent permitted by law, Kinobo Studios Limited and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the App. Our total liability for any claim relating to these Terms shall not exceed the amount you paid for the App or subscription during the preceding twelve months.
We reserve the right to suspend or terminate your access to Eat The Frog at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
We may update or modify these Terms from time to time. If changes are material, we will update the effective date above and provide notice within the App or on our website.
These Terms are governed by the laws of England and Wales. If you live outside the United Kingdom, you may also be protected by the mandatory laws of the country where you live.
If a dispute arises, we hope you'll contact us first at [email protected] so we can try to resolve it together. If we can't reach an agreement, you may bring legal proceedings in the courts of England and Wales, or—if required by local law—in the courts of your home country.
